I was stopped at the Yuma immigration Checkpoint and the found a very small amount of marijuana in my car.  I was badly mistreated by the boarder patrol agents.  Mr. Cates fought for my rights filing several motions and setting my case for trial.  In the end, the Yuma Prosecutor dismissed all charges.  Dwane, you are the man.

I was stopped at the immigration checkpoint in Arizona and given a ticket to show up in Court in the Wellton Justice Court to face drug charges. I was scared and embarrassed by this and did not want to tell my parents. Unknown to me, a local lawyer (ambulance chaser) sends out letters to all persons given tickets at this check point. This letter went to my parents address. My dad called this local lawyer and she told him that I should just plead guilty and that she would get my record expunged and that there was no way to get my charges dismissed. My father did not take her word for it and called some other attorneys. He contacted Mr. Cates at this firm. He explained that there is no such thing as an expungement (make the records go away) in Arizona and that all that could be done was to set aside the judgment of guilt. This would take away the conviction but the records will always show that I was charged, plead guilty and that the judgment was later set aside. For me that was not good enough. Mr. Cates reviewed my case and believed that there as a good possibility that the could get the charges dismissed. We hired him even though he cost more, but I am glad we did. He got the case dismissed. The lesson here is watch out for unsolicited offers of representation. Call Dwane for the honest answers to your questions.

I was with some friends and was stopped at an immigration checkpoint near Wellton, Arizona. They ran a drug dog around the car and found some pot. It was not my pot and I refused to talk to the agents and my friends did the same. Same old story, stopped and searched at the check point in Arizona and arrested for a drug crime. I there was only a little marijuana in the car. I refused to talk to the cops and they gave me a ticket anyway. I was contacted by an attorney by letter wanting to represent me in court. She wanted me to plead guilty. Immigration Checkpoints on I-8 in Arizona

When traveling through Arizona you may come upon an Immigration checkpoint. If you do, beware. They are looking form more than illegal immigrants. They are also looking for drugs. At the I-8 checkpoint near Yuma I have represented many client arrested with less than 1/4 gram of marijuana.

When you pull into the checkpoint they have a drug dog sniff your car. If the dog alerts, and sometimes even if they don’t, the border patrol agent will send you over for a secondary inspection. At this point they will ask you if they can search your car or if they can have their dog search your car. You can refuse this search. However, many of my clients stated that the agent told them that if they allowed the search or told them where the drugs were that they would just cite and release them. If they did not cooperate they were told that they would be taken to jail when the drugs were found and their car impounded. This is a scary proposition when you are miles from home at a checkpoint in the middle of nowhere.

If a small amount of drugs are found the agents will question you about the drugs. Again you will be encouraged to cooperate. But you must understand that you have the right to remain silent and you are much better off if you do. If the amount of marijuana is small and you have no prior record, they will cite and release you. You will be given a court date in Wellton Justice Court. In most cases we can make it so that you do not have to personally appear in court. We can appear for you in the first few court dates and if your appearance is necessary we can generally arrange for you to appear by telephone unless you are scheduled to appear for trial.

You must understand that Possession of Marijuana in Arizona is a felony. For a first offense of possession of marijuana for personal use they can not put you in jail if convicted. With that said, they can make your life miserable other ways. They must put you on probation and it can be either supervised or unsupervised probation. If they want to they can put you on probation which would make it difficult for you to leave Arizona. There can be large fines and other implications of a drug conviction. If you were arrested for marijuana possession and not possession of dangerous drugs or possession of narcotics. They will most likely give you a traffic ticket and complaint. They will list possession of marijuana / attempt and possession of drug paraphernalia / attempt. They do this so that the charges may be handled as misdemeanors in Wellton Justice Court. But be careful. The prosecutor can and sometimes does dismiss the attempt charge and recharge the crime in Yuma Superior Court as a felony.

If the Boarder Patrol Agent finds Cocaine, Meth, Heroin or outer narcotics you will be taken into custody. They will call the DPS agent to place you under arrest and you will be take to the Yuma County Detention Facility. Within 24 hours you will see a judge and they will set a bond. (A good bondsman is McCurley Bail Bonds (928) 782-4400). You will have a series of Court dates in the Yuma County Superior Court. Depending upon the amount of drugs found you may be facing anything from probation to a long prison sentence. Arizona is not a good place to get caught with drugs.
